As previously reported, the City of Cleveland Heights was considering an ordinance to address lead paint contamination in homes. ACAR, along with many Realtors, shared concerns about the ordinance, namely that real estate agents should not be held as liable as the property owner for failure to comply with the ordinance.
At its meeting on October 17, 2022, the City Council passed the ordinance as amended to reflect the following, "an agent who has fulfilled such responsibilities shall not be liable for the failure to disclose to a purchaser or lessee the presence of lead-based paint and/or lead based paint hazards known by a seller or lessor but not disclosed to the agent."
