October’s lower inflation rate is a welcome sign for a housing market that’s seen steady declines in 2022. Annually, the REALTORS ®  Political Action Committee (RPAC) trustees spend days upon days fundraising. However, the most important responsibility the trustees have is evaluating selected candidates in Cuyahoga, Portage, and Summit Counties to determine whether they (the candidates) are REALTOR ®  Party champions worthy of RPAC support. The Parma Public Housing Agency is pleased to introduce a new (limited-time) program to offer SECURITY DEPOSIT assistance for all subsidized families of newly leased units.   Although this is a Parma Public Housing program, homes may be located throughout Cuyahoga County.  Please follow this link for more information about this new incentive for housing providers. Parma Public Housing wants to work with Realtors to help tenants identify possible homes. As previously reported, the City of Cleveland Heights was considering an ordinance to address lead paint contamination in homes. ACAR, along with many Realtors, shared concerns about the ordinance, namely that real estate agents should not be held as liable as the property owner for failure to comply with the ordinance. At its meeting on October 17, 2022, the City Council passed the ordinance as amended to reflect the following, " an agent who has fulfilled such responsibilities shall not be liable for the failure to disclose to a purchaser or lessee the presence of lead-based paint and/or lead based paint hazards known by a seller or lessor but not disclosed ...

ACAR recently received notice from the City of Kent that some buyers did not receive its "Zoning Use Certificate" before the transaction closed. As a result, "the new owners were unaware of the zoning use restrictions that are in place for the property they recently required."  Codified Ordinance Letter If you have a client considering a property in Kent, Ohio, be sure to familiarize yourself with Section 1101.01(D). Pay to Stay Ordinances A handful of municipalities throughout Ohio have enacted pay-to-stay ordinances. These policies gained steam during the pandemic as emergency rental assistance became available. In cities where the policy exists, tenants have access to this affirmative defense in eviction cases for non-payment only. Ordinances typically cap late fees charged and allow the tenant to pay any back rent owed up until the time of the eviction hearing. If you follow the news out of Akron, you know that multi-family housing and rental policy were hot topics earlier this summer. With poor conditions at properties formerly owned by AMHA, new owners have come under fire for said conditions and caught the attention of numerous parties. This attention led to the establishment of a Safe Housing Steering Team that is tasked with taking a comprehensive look at rental housing conditions and regulations in the City. On the Horizon: ACAR Government Affairs Update While it has certainly been a busy year with candidate interviews and various public policy challenges, ACAR’s advocacy efforts show no signs of slowing down as we head into to the 4th quarter of the year. Here’s a snapshot of what’s coming down the pike: Placemaking - weather pending, ACAR will be assisting with the development of 2 placemaking sites this fall. One project is a pedestrian plaza near the W. 25th RTA Station in Cleveland. The second project is the creation of a pocket park in Akron. ACAR Board of Directors passes DEI statement, plans to establish new standing committee At the Board of Directors meeting on August 24, 2022 members voted to pass six actions based on the report prepared by the Diversity, Equity & Inclusion Presidential Advisory Group (DEI PAG). Earlier this month, ACAR launched an online campaign to educate the public about point of sale inspections. These inspections are one of the worst policies a city can pass if they are serious about addressing property maintenance and ensuring their city is one that first time and LMI buyers can consider when going through the home buying process.
